The agreement
These terms are an agreement between you and Hook'd IT Up (“we”, “us”), which runs Mark'd IT Up, a Hook'd IT Up product. They apply whenever you use Mark'd IT Up, whether you hold an account or open a review link someone sent you.
If you use Mark'd IT Up on behalf of a business, you are agreeing for that business and confirming you have the authority to do so. Our Privacy Policy explains what we do with personal information, and forms part of these terms.
Accounts and workspaces
Mark'd IT Up is organized into workspaces. A workspace belongs to an agency, holds its projects, and is what a plan is bought for. People join a workspace by invitation, as an owner, admin or member. Owners and admins can manage the team, branding and billing.
- Give accurate details, and keep your email address current.
- Keep your password and sign-in links to yourself. You are responsible for what happens under your account and in workspaces you administer.
- Tell us at markd@hookditup.com if you think someone has got into your account.
Reviewers do not need an account. A review link is the reviewer's access, so anyone holding it can open it. You can add a password to a link, set it to expire, and revoke it at any time.
The sites you capture and the people you invite
Mark'd IT Up takes screenshots of websites from the outside, using a crawler that identifies itself as Mark'd IT Up. You choose which sites it visits, so you are responsible for:
- Having the right to capture every site you add — because you own it, your client does and has agreed, or you are otherwise permitted to.
- Any login details you give us for a staging site. We use them only to capture that site.
- The clients and teammates you invite and the review links you share, including what they post in your workspace.
- Telling your clients how their comments and details will be used, and having whatever permission the law requires to collect them.
If someone makes a claim against us because of a site you captured without the right to, or because of content you or your invitees put into Mark'd IT Up, you agree to cover our reasonable costs of dealing with it.
Acceptable use
Do not use Mark'd IT Up to:
- Capture sites you have no right to capture.
- Try to get around plan limits — for example by splitting one agency across several trial workspaces, or by tampering with requests.
- Try to reach another workspace's data, guess or collect review links that were not shared with you, or probe our systems for weaknesses.
- Point the crawler at addresses that are not public websites, or use it to overload a site.
- Upload anything unlawful, infringing or malicious, or use comments and attachments to harass anyone.
- Resell or rebrand the service except through the white-label features of your plan.
If you find a security problem, please tell us at markd@hookditup.com rather than testing it further.
Your content
You own what you and your clients put into Mark'd IT Up: the screenshots of your sites, comments, drawings, attachments, logos and the rest. You give us permission to store, copy, process and display it only as needed to run the service for you — capturing, showing it to the people you share it with, sending the emails you have asked for, and keeping backups.
We do not sell your content, and we do not use it to advertise to anyone.
Plans, billing and trials
Trial. A new workspace starts with a 14-day free trial. A paid subscription also begins with a 14-day trial: a card is required to start it, and the first charge is made when that trial ends. Cancel before then and you are not charged.
Billing. Plans are billed monthly or yearly, in advance, in US dollars, at the prices on our pricing page. Payments are handled by Stripe. A subscription renews automatically at the end of each period until it is canceled.
Changing plan. Owners and admins can move between plans and between monthly and yearly billing from Settings › Billing. A change applies to the same subscription, and Stripe prorates the difference.
Canceling. Cancel at any time from Settings › Billing, which opens Stripe's customer portal. The portal shows when the cancellation takes effect before you confirm it.
Refunds. Monthly payments are not refunded, in whole or in part. A yearly payment is refunded in full if you ask within 30 days of being charged, whether for a first purchase or a renewal: email markd@hookditup.com. We always refund a charge made in error, such as a duplicate charge. A credit from moving to a smaller plan is applied to later invoices, not paid out. None of this limits a refund the law requires.
Failed payments. If a payment fails, the workspace keeps working while Stripe retries. If the retries run out, the subscription ends and the workspace is paused as described in Data retention.
Price changes. If we change the price of your plan, we will tell you before the new price applies, and it will take effect from your next billing period.
Plan limits
Each plan has three limits — active projects, pages per crawl, and rounds a month — listed on the pricing page. They are the same numbers the app enforces. Reviewers, comments and teammates are unlimited on every plan.
Reaching a limit never costs extra. A new round waits until the count resets on the 1st of the month (UTC), or until you move up a plan.
Data retention
While your workspace has an active plan, we keep every round — screenshots, comments and attachments — for as long as the account exists.
When a paid plan ends or a trial expires, new work is paused and everything is kept for 90 days. We email the workspace's owners and admins 30 days and 7 days before anything is deleted. After 90 days, the workspace's projects, screenshots, comments and attachments are permanently deleted. Starting a plan again before then keeps everything, exactly as it was.
Deleted files are removed from storage by a background process shortly after the records that point to them. The Privacy Policy covers backups and account details.
White-label and custom domains
On Studio and Agency, review pages carry your logo and colors with no Mark'd IT Up credit line, and review links can use your own domain. On Solo and during the trial, review pages show your logo and colors with a small credit line, and links use our address.
To use a custom domain you must own or control it and add the DNS record we give you. Links switch to your domain only once it is answering correctly. If your workspace moves to a plan without white-label, review pages show the credit line again and links go back to our address.
Availability
We work to keep Mark'd IT Up running and your data safe, but we do not guarantee any particular uptime. The service may be unavailable for maintenance, because of a problem with one of the providers we rely on, or for reasons outside our control.
Some sites cannot be captured — they block crawlers, need a login we do not have, or fail to load. When a capture fails, we say so in the app and email the workspace's owners and admins.
We may change or remove features over time. If we stop offering Mark'd IT Up altogether, we will tell you in advance.
Suspension and termination
You can stop using Mark'd IT Up at any time by canceling your plan. To have your workspace deleted sooner than the retention schedule, write to markd@hookditup.com.
We may suspend or close a workspace or account that breaks these terms, puts other customers or our systems at risk, or that we are legally required to act on. Where it is reasonable to, we will tell you first and give you a chance to fix the problem. After closure, your data is handled as described in Data retention.
Disclaimers
Mark'd IT Up is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms — including any implied promises of merchantability, fitness for a particular purpose, or non-infringement. A screenshot shows a page as it loaded for our crawler at that moment; it may differ from what a particular visitor sees.
Limitation of liability
To the extent the law allows:
- Neither of us is liable to the other for indirect or consequential losses, such as lost profits, revenue, business or goodwill.
- Our total liability for any claims relating to Mark'd IT Up is limited to the amount you paid us for it in the 12 months before the claim arose.
These limits do not apply where the law does not allow them to, such as for fraud.
Changes to these terms
We may update these terms. The date at the top always shows when they last changed. If a change materially affects you, we will email workspace owners before it takes effect. Continuing to use Mark'd IT Up after that means you accept the new terms; if you do not, you can cancel.
Governing law
These terms are governed by the laws of the State of Utah and applicable US federal law. Any dispute will be heard in the state or federal courts located in that state, unless the law where you live gives you the right to bring it elsewhere.
